Behavee Privacy Policy

Data Privacy and protection is one of the major pillars on which Behavee service is build up as we consider the privacy of Your data of highest importance. When building our solution and prior each system change all applicable regulations including the General Data Protection Regulation (“GDPR”) and all applicable laws of the Czech Republic are considered.

This Privacy Policy describes in detail the data privacy and protection practices of Behavee s.r.o. (“Behavee”) on the Site. If you visit site that is running services provided by Behavee, the End users section of this Privacy Policy is applicable to you.

1. Definitions

“Site/s” shall mean the website Behavee.com, in addition to any sub-pages that are integrated within this website (including portal.behavee.com);

“Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

“Customers” shall mean commercial persons and entities who own and operate their own websites or mobile applications (“Customer sites”) and who wish to utilize Behavee (our code, software and services and reports to analyze how third party visitors to their sites (“End users”) use, interact with, and engage their sites.

“Behavee Enabled Site” shall mean any website that is running services provided by Behavee.

​

“End users” shall mean visitors of the site that is running services provided by Behavee (“Behavee Enabled Site”).

2. Scope

Behavee is in general the controller of Information that it collects from and about the persons and entities who are visiting the Behavee Site (“Behavee Visitors”, “You”), and this Privacy Policy applies to Behavee Visitors.

Behavee also provides services to commercial persons and entities (“Customers”) who own and operate their own websites or mobile applications (“Customer sites”) and who wish to utilize Behavee (our code, software and services and reports to analyze how third party visitors to their sites (“End users”) use, interact with, and engage their sites.

Customers are the Controllers of information collected from the End users, whether or not such information is accessed, analyzed, or otherwise utilized by or on behalf of the Customer via Behavee (“Usage information”); Behavee is not the Controller of such Usage data. This Privacy Policy applies to the use of Services by our Customers. However, this Privacy Policy does not apply to the Customer Sites themselves, nor to any Usage information. For any questions regarding the privacy, security, or other practices or policies on the Customer Sites, please contact the applicable Customer.

3. Collected information

Usage Information Collected

When you visit the Site (or Behavee Enabled Site) we receive, collect and store certain information provided by the web browser or otherwise by the access device. We may also receive information about You from the prior website visited by You. For instance, the information such as your internet service provider, the website from which you visited us from, the parts of our site you visit, the date and duration of your visit, and information from the device (device type, operating system, screen resolution, language, country you are located in, and web browser type) you used during your visit. We only collect and store a truncated version of your IP address. It is captured and stored in an anonymized format, so your full IP address never reaches our servers and we never have access to it.

Registration Information

When You register as customer to use the Behavee, you submit certain information such as e-mail mailing address, phone number, financial information (e.g., credit card number, billing address), and/or proposed Partner / Customer Site to be tracked, to process the registration or request.

As described and stated in this Privacy Policy, we will use and process this information to provide you with the service you signed up for. For details about registering and Behavee service, please refer to Behavee Terms of Service.

Cookies

As described in our Cookie Policy, Behavee uses cookies on this site. Cookies are small data files transferred onto computers or devices by sites for record-keeping purposes and to enhance functionality on our site. We collect standard internet log information and details of user behaviour patterns. We do this to provide you with a better experience and for several functions including remembering user preferences, visited pages, time and dates, and other metrics. We only collect and work with anonymous data, i.e. in a way which does not personally identify anyone.

Information collected by or on behalf of Behavee customers

Behavee customers use Behavee service to obtain information about how End users are interacting with their Sites (Behavee Enabled Sites). Behavee provides tools to monitor, evaluate and personalize their sites based on the collected usage information.

4. Information usage

We process this usage data to facilitate your access to our services (e.g. to adjust our services to the device you are using), and to recognize and stop any misuse. We also process usage data in an anonymized form for statistical purposes and to improve our site.

Behavee use of Behavee customer Information

For example, Behavee may use Your information for:

  • Authentication of Your access;

  • Registration;

  • Process customer requests and purchases;

  • Check customer credibility;

  • Personalize Your experience and product offer for you;

  • Other legitimate business interests.

Our Clients' Use of Client Visitor Information

Each Behavee customer hereby:

  • Agrees and confirms to use Behavee service only in accordance with the Terms of Service and applicable law;

  • Warrants, and covenants that it will abide all applicable laws, rules, and regulations applicable to End users and Usage information;

  • Warrants, and covenants that it will obtain all consents required under applicable laws or regulations for the processing of Usage information under the Service as described hereunder and in the Terms of Service and as otherwise instructed by the Customer;

5. Parties and Access to information

End Users

This section applies to you if you are a visitor of a Behavee Enabled Site (website that is running services provided by Behavee).

​

Please note that details regarding the processing of your personal data should be specified in the Privacy Policy of the Behavee Enabled Site. Behavee helps its customers to provide better services and experience to their end users, enhanced functionality and customized content of the Behavee Enabled site, but processes only anonymized data. Third parties

​

Behavee uses only a selection of trusted external service providers to support the operations of the service (e.g. infrastructure, data analytics). Each external service provider is carefully selected to meet our high security and protection standards.

 

Only the information that is necessary to provide the agreed services is shared and they never have access to your data directly. We have contractual bindings with all our service providers to keep all information confidential, never disclose it and process it only in accordance with the instructions.

We will only pass your data to third parties without your explicit consent if we are obliged to do so by statutory law or an instruction by a public authority or court. For more details, please refer to our Terms of Service.

6. Data processing

Processing of Usage data

We are using anonymized (end user) actual behaviour and we are aggregating the behaviour into the microsegments. In practice all personal data of the End users are stored on Customer side, we only see anonymized data. Behavee customers then can use outputs from Behavee and address the offers to their End users. We do not expect Behavee with actual product setup to become personal data processor for the End users, but only for You on Your behalf.

Behavee is not designed to knowingly collect or extract from End users information that could be used to personally identify End users, such as a name, address or phone number ("Personal Data") when an End user visits a Customer Site that uses the Behavee service (“Behavee Enabled Site“). Behavee does not attempt to identify, decipher, access, or associate Personal Data regarding the End user from any Recorded Interactions or Device Information.

Responsibility for Processing Personal Data

Behavee bears responsibility for lawfully processing Your data as carried out on our site.

Your rights

​

We in Behavee strongly believe that Data Privacy and Protection is of utmost importance and so we build our service based on the key principles of GDPR and other Privacy requirements.

You have all the rights as described in GDPR regulation including right to be informed about personal data processed by Behavee, a right to rectification/correction, erasure and restriction of processing, right to object against processing of data above purposes on the basis of Behavee’s legitimate interests, right to receive the personal data in a structured, common and machine-readable format. We can only adhere to your request and provide information if we have personal data about you through you having made contact with us directly and/or you using our site and/or service.

Where you have provided consent, you have a right to withdraw it at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the Behavee Site and/or Services. You further agree that Behavee shall not be held liable with respect to any loss and/or damage to your Personal Data if you choose to withdraw consent.

Duration of Processing, Retention and Deletion of Usage data

We will store your usage data until such time when you withdraw your consent for us to do so. All other data as specified above will be retained for as long as is necessary for the purpose(s) for which we originally collected it and that is described in this Privacy Policy  and Terms of Service. We may also retain information as required by law.

You agree and acknowledge that deletion of Usage data may affect the delivery of the service. If you wish and request the deletion of Your data in Behavee and this is not in conflict with applicable law, we will comply with the requirement as soon as reasonably possible and with maximum period of 90 days.

7. Security and Protection of Your data

In line with our commitment to ensure Security, Privacy and Protection of Your Data, we implement security measures and mechanisms to secure all collected information from loss, misuse and unauthorized access, disclosure, alteration and destruction, based on internationally recognized best practices and standards. Behavee data storage is based in cloud located exclusively within EU domain.

8. Revisions / Changes to Our Privacy Policy

We retain the discretion to revise, amend or modify this Privacy Policy from time to time. The most current version is always available on the Site and our practices for collecting, processing, and disclosing personal data is governed by it. We will notify you about any modifications by one or more of the following means: a direct communication to your Behavee account, a communication to the e-mail address associated with your account (unless you have unsubscribed from all email communications), or a clear and prominent announcement on the Site.

 

All changes to this Privacy Policy automatically take effect on the sooner of the day you use the site and/or services, or 30 calendar days after they are initially posted on our site. Your use of the site and/or services following the effective date of any modifications to this Privacy Policy will constitute your acceptance of the Privacy Policy, as modified.
